At Zagster, we recognize that earning and retaining your trust is one of the most important things we do as a business. Protecting your privacy is a responsibility we take very seriously.
What information do we collect from the people that visit our websites or Mobile Applications?
We receive and store any information you enter on our websites or give us in any other way. We collect two types of information from you on our websites,Mobile Applications, and via email. Personal Information is information that identifies you personally, such as your first and last name, email address, telephone number, postal and email addresses, user name and password, and billing information (such as your credit card number, cardholder name, and card expiration date). We also collect Other Information that does not identify you personally, such as gender, country of residence and other demographic information.
When joining a Zagster bike share program on ourweb site or Mobile Applications, as appropriate, you may be asked to enter your:
- Email address
- Billing address
- Phone number
- Credit Card Number, expiration date & security code and or information regarding your PayPal, Google Wallet or other digital payment accounts
If you make a reservation with Zagster, we will collect payment information from you, including your credit card number, cardholder name, expiration date, authentication code, and billing address. We may offer members the option to save information related to method and choice of payment on our websites. If you save such payment details on Zagster, you will be able to add, delete, or modify that information at any time in your Account Settings.
Information We Collect As You Access And Use Our Services
In addition to any Personal Information or Other Information that you choose to submit to us, we may use a variety of technologies that automatically (or passively) collect certain information whenever you visit or interact with the Services (” Usage Information”). This Usage Information may include the browser that you are using, the URL that referred you to our Services, all of the areas within our Services that you visit, and the time of day, among other information. We may use Usage Information for a variety of purposes, including to enhance or otherwise improve the Services. In addition, we collect your IP address or other unique identifier (” Device Identifier”) for your computer, mobile or other device used to access the Services (any, a “Device”). A Device Identifier is a number that is automatically assigned to your Device used to access the Services, and our computers identify your Device by its Device Identifier. Usage Information may be non-identifying or may be associated with you. Whenever we associate Usage Information or a Device Identifier with your Personal Information, we will treat it as Personal Information.
Information Collected by Mobile Applications
Our Services are primarily provided through an application on your mobile, tablet computer or similar device (“Mobile Application”). You agree that we may collect and use technical data and related information, including but not limited to, technical information about your device, system and application software, and peripherals, that is gathered periodically to facilitate the provision of software updates, product support and other services to you (if any) related to such Mobile Applications.
When you use any of our Mobile Applications, the Mobile Application may automatically collect and store some or all of the following information from your mobile device (“Mobile Device Information”), including without limitation:
- Your phone number or other unique device identifier assigned to your mobile device – such as the International Mobile Equipment Identity or the Mobile Equipment ID number.
- The type of mobile Internet browsers you are using.
- Your geolocation
- Information about how you interact with the Mobile Application and any of our web sites to which the Mobile Application links, such as how many times you use a specific part of the Mobile Application over a given time period, the amount of time you spend using the Mobile Application, how often you use the Mobile Application, actions you take in the Mobile Application and how you engage with the Mobile Application.
- Information to allow us to personalize the services and content available through the Mobile Application.
We may use information automatically collected by the Mobile Application (including the Mobile Device Information) in the following ways:
- To operate and improve our Mobile Applications, other Services, our company’s services, and tools.
- To create aggregated and anonymized information to determine which Mobile Application features are most popular and useful to users, and for other statistical analyses.
- To customize the content or services on the Mobile Application for you, or the communications sent to you through the Mobile Application.
You acknowledge and agree that Zagster may track your location and use of Zagster bicycles using GPS Beacons on the Zagster bicycles. Zagster may track your location in increments of 15 to 60 minutes. Data collected using GPS Beacons will be used by Zagster to enforce the terms of Zagster’s user agreements, to protect the bicycles from theft and to locate the bicycles if lost, to improve the Zagster bicycle sharing service, for advertising and marketing purpose as compiled in an aggregated anonymous manner with data from other users, to ensure the GPS Beacon is working properly, and for Zagster’s internal business purposes in managing and reporting on use of the Zagster service and bicycles.
We may associate your unique mobile Device Identifier or Mobile Application usage information with any Personal Information you provide, but we will treat the combined information as Personal Information.
When do we collect information?
We collect information from you when you register on our website or Mobile Application, respond to a survey or enter information on our website or Mobile Application.
How do we use your information?
We may use the Personal Information we collect from you when you register, make a purchase, sign up for our newsletter, respond to a survey or marketing communication, surf the website, or use certain other site features in the following ways:
- For registration and to manage your account, including to allow your access to and use of our site; to communicate with you in general.
- To personalize user’s experience and to allow us to deliver the type of content and product offerings in which you are most interested.
- To improve our website in order to better serve you.
- To allow us to better service you in responding to your customer service requests.
- To administer a contest, promotion, survey or other site feature.
- To quickly process your transactions.
- To send periodic emails regarding your Zagster membership or other products and services.
- To resolve disputes or troubleshoot problems
- To prevent potentially prohibited or illegal activities
- As otherwise described to you at the point of collection
How do we protect visitor information?
At Zagster we seek to maintain the integrity and security of your Personal Information.
We use industry-standard encryption protocols when receiving and transferring your Personal Information. In fact, when you send Personal Information to us over the Internet, we first require that a “secure session” be established using Secure Socket Layer (SSL). Our website is scanned on a regular basis for security holes and known vulnerabilities in order to make your visit to our site as safe as possible. We use regular Malware Scanning.
We seek to store your Personal Information in secure operating environments that are not accessible to the general public, and to have security measures in place at our physical facilities to protect against the loss, misuse or alteration of your Personal Information by our employees or third parties. In addition, all sensitive/credit information you supply is encrypted via Secure Socket Layer (SSL) technology. We implement a variety of security measures when a user enters, submits, or accesses their information to maintain the safety of your Personal Information. All transactions are processed through a gateway provider and are not stored or processed on our servers.
However, no data transmission over the Internet or data storage environment can be guaranteed to be 100% secure, so we cannot give an absolute assurance that the information you provide to us will be secure at all times. Zagster will not be held responsible for events arising from unauthorized access to your Personal Information. Zagster will rely on you telling us if you experience any unusual events that may indicate a breach in your information security. We will then seek to investigate whether the security breach was related to the data transmissions from or to Zagster and let you know what steps can be taken and have been taken to help rectify the problem. Further action, such as reporting incidents to the police or other proper authorities, may also be required.
Do we use ‘cookies’?
You can choose to have your computer warn you each time a cookie is being sent, or you can choose to turn off all cookies. You do this through your browser (like Internet Explorer) settings. Each browser is a little different, so look at your browser’s Help menu to learn the correct way to modify your cookies. If you disable cookies off, some features will be disabled that make your site experience more efficient and some of our services will not function properly.

We may also use or disclose Personal Information as we believe to be necessary or appropriate: (a) under applicable law, including laws outside your country of residence; (b) to comply with legitimate and enforceable subpoenas, court orders, or other legal process; (c) to respond to requests from public or government authorities, including public or government authorities outside your country of residence; (d) to enforce our terms and conditions or otherwise establish or exercise our legal rights; (e) to protect and defend our rights, property or safety or those of any of our affiliates, our customers, or others; (f) to protect our rights, privacy, safety or property, or that of our affiliates, you or others; (g) to allow us to pursue available remedies or limit the damages that we may sustain; (h) To investigate, prevent, or take action regarding illegal or suspected illegal activities; (i) in connection with a corporate transaction, such as a divestiture, merger, consolidation, or asset sale, or in the unlikely event of bankruptcy; or (j) as otherwise required by law
Other than as set out above, you will be notified when Personal Information about you will be shared with third parties, and you will have an opportunity to choose not to have us share such information.
We also may share aggregate or anonymous information with third parties, including advertisers and investors. For example, we may tell our advertisers the number of visitors our website receives. This information does not contain any Personal Information and is used to develop content and services we hope you will find of interest.
We may use and disclose Other Information for any purpose, including marketing and advertising. In some instances, we may combine Other Information with Personal Information (such as combining your name with your geographical location). If we combine any Other Information with Personal Information, the combined information will be treated by us as Personal Information, as long as it is so combined.

You also can add or update information and close your account as described above. In addition, as described above, you may opt out from receiving e-mail communications from Zagster. Please note that we reserve the right to send you other communications, including service announcements, administrative messages, and surveys relating either to your Zagster account, without offering you the opportunity to opt out of receiving them. The Help portion of the toolbar on most browsers will tell you how to prevent your browser from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether. Please note that if you refuse to accept cookies from Zagster, you will not be able to access portions of our site.

We take reasonable steps to ensure that your information is relevant to its intended use, accurate, and complete. You can access and update your contact information by accessing your account via the Zagster website. If you update any of your information, we may keep a copy of the information that you originally provided to us in our archives for uses documented in this policy. You can also close your Zagster account by accessing your account via the Zagster website. We will send you an email to confirm your request. Please note that after you close an account, you will not be able to sign in or access any of your Personal Information. However, you can open a new account at any time.
Please also note that we may retain certain Personal Information and Other Information associated with your account in our archives, including for analytical purposes as well as for recordkeeping integrity, fraud prevention, dispute resolution, investigations, and compliance with legal requirements.
